With the advancement of technology, the type of language used to write this act can be used to stop online sports betting. This is done because words like paraphernalia, paper, and device are used up to the courts to find out if the method that is used falls under any of these classifications. Professional and Amateur Sports Protection Act
The only purpose of this law is to ban online sports betting. This law works with the wire act in the USA to make it illegal for everyone in the country to place bets on sporting events. Like football, basketball, and baseball through the internet and any other wire transfer methods. In addition, some sporting events however are allowed by law to be bet on through the internet. Some sports are exempted from the law like for example pari-mutuel horse racing and dog racing.
Apart from that, when the law was first made in the US government included a grace period for states. That had been allowing online sports betting to change their sports betting so that it could continue without breaking the law. Moreover, this grace period was for New Jersey. New Jersey didn’t take advantage of this opportunity and has filed a lawsuit stating the law is inherently illegal.
Moreover, other states do have sports lotteries that don’t fall under the guidelines of the PASPA law and are still legal for online betting. And these states include Delaware, Montana, and Oregon. Furthermore, the law allows US people the US to participate in sports betting with an offshore online casino.
Most people are demanding for this law to be removed but even if the law is removed the use of online means to place bets on sporting events would still be seen as illegal due to the Federal Wire Act. Removing this law will only be allowed to work in land-based casinos.
Illegal Gambling Business Act
The main purpose of the Illegal Gambling Business Act was to end the involvement of organized crime in the gambling business. In this law, they state that any gambling operation that is breaking the state’s law or local law that has five or more people conducting its casinos and remains to continue operating for 30 days or makes more than $2,000 in revenue in a day can be prosecuted.
In addition, this law doesn’t include a person who is betting to be found under this law but anyone who is working for gambling itself can be. Meaning that any person who is the owner of gambling business to the runners can fall under this law prevue.
